The List Bar LLC
Terms of Service
These terms are the agreement between you and The List Bar LLC, a Colorado limited liability company ("The List Bar", "we", "us"), for your use of our website, workspace and services.
Version 1.0 · Last updated September 21, 2026
1. Acceptance of these terms
By requesting access, signing in, placing an order, or paying for a service, you agree to these terms. If you do not agree, do not use the service.
If you use the service on behalf of a team or business, you confirm you are authorised to accept these terms for it.
2. Eligibility
The service is built for licensed real estate professionals and their teams, and is intended for business use only. You must be at least 18 years old and hold any licence your work requires.
Access is granted by review. Submitting a request does not create an account, and we may decline or withdraw access at our discretion.
3. Your account
Your sign-in is personal to you. Keep your password confidential, do not share your login, and tell us promptly at support@thelistbar.com if you believe someone else has used it.
You are responsible for everything done through your account, including work your team members or assistants submit using it.
5. What we do — service scope
The List Bar provides brokerage-agnostic real estate operations support. Software and experienced human operators work together: we organise, coordinate, prepare and track the work, and you and your supervising broker review and approve it.
What is included depends on the package or order you buy, as presented at the time of purchase. Anything not described in that package or order is not included.
- MLS Ready — a streamlined MLS and listing input workflow. You supply the required listing information and media. It does not include contract work and does not include marketing execution.
- Curated and Signature — broader listing launch support and coordination across the steps shown in the package when you buy it.
- Selected packages may include brochure design, printing and delivery.
- Ongoing operations plans — recurring operations support billed monthly, as described on the plan you activate.
- Local field services — for example lockbox installation and removal, vacant property checks and photo-day prep.
- Coordination of third-party services such as photography, and administrative assistance with listing paperwork and forms.
6. What we are not
The List Bar is not your brokerage, your attorney, your title company, your MLS, your photographer, or your insurer. We do not supervise you and we do not replace broker supervision.
Administrative help with contracts, forms, disclosures and listing paperwork is administrative only. It is not legal advice, and it is not a legal, tax, appraisal or compliance opinion. You and your supervising broker remain responsible for choosing the right forms, for legality, for review, for signatures, for compliance with MLS and brokerage rules, for deadlines, for accuracy, and for final approval before anything is filed, published or sent.
Data you enter is your and your brokerage's record. You are responsible for keeping your own required records.
7. Your review before anything goes live
Listing content, MLS entries, forms, dates and marketing materials we prepare are drafts for your review until you approve them. You are responsible for checking them, correcting them and approving them.
We do not guarantee sales results, MLS acceptance, vendor availability, uninterrupted software, or that any date will be met, unless a specific order says so in writing.
8. Software and AI-assisted work
We use software and, in places, AI to organise requests, route work, draft text and run quality checks. Human operators remain involved in the work we deliver.
AI-assisted output can be incomplete or wrong. Treat it as a draft: it still requires your review and your supervising broker's approval before use.
9. Third-party services and vendors
Some work involves third parties, including photographers, printers, couriers, sign and lockbox suppliers, and scheduling tools. Where a third party contracts with you or bills you directly, that relationship is between you and them on the terms they present.
We coordinate third-party work in good faith, but we do not guarantee any vendor's performance, availability, pricing, timing or quality. Third-party costs you approve remain payable.
10. Payments
Prices are shown before you pay. One-time services — including listing packages and field services — are charged at the amount presented at checkout. Payments are processed by our payment processor; we never receive or store your full card details.
Work begins after payment is received or, where a package allows it, after we confirm the order. A saved request that has not been paid is not active work, and nothing is scheduled until we confirm it.
Contract to close is paid in two parts: a deposit at checkout, when your card is saved, and the balance, which we charge to that card when the deal closes. If the deal falls through, nothing more is charged and the deposit is kept. If the card is declined at closing, you pay the balance from the request. The AI listing video is made from your listing photos and is unbranded; you are responsible for disclosing that it is AI-generated wherever you share it.
You are responsible for any taxes that apply to you. Failed or reversed payments may pause work.
11. Monthly operations plans
Operations plans are billed monthly in advance and renew automatically each month until cancelled. You can cancel at any time; cancellation takes effect at the end of the current paid billing period, and you keep access until then.
We do not give partial-month refunds except where the law requires it. If we change a plan price, we will tell you before the change applies to you.
Membership is limited, and a plan is sized for typical use. If your needs grow well beyond that, we will talk with you about the right fit before anything changes. We work in your brokerage's tools through a team or assistant seat, or from what you send us, and never ask for your own sign-in details.
12. Cancellations, refunds and date changes
You can ask us to cancel or reschedule an order from within your workspace. A cancellation or date change is a request and is not effective until The List Bar confirms it.
Before work on an order has begun, a payment may be refunded on an approved cancellation, less third-party costs we cannot recover and payment-processing costs, where deducting them is lawful.
Once work has begun, payments are non-refundable, except at our discretion or where the law requires a refund. We decide full, partial or no refund case by case, based on what has already been done and committed. Nothing here promises an automatic refund.
For inspection attendance and photo-day prep, your card is held at checkout and charged only when we confirm the visit. If we can't attend, we release the hold and nothing is charged. If we confirm a visit and then can't attend, we will tell you as soon as we know and refund that visit in full.
A Contract to close can be cancelled for a full refund of the deposit on the day you request it, before we start the file. After that, the deposit is non-refundable.
Third-party and vendor costs you approved, and work already performed, remain chargeable.
13. Acceptable use
You agree not to:
- use the service for anything unlawful, discriminatory, fraudulent or misleading, including content that breaches fair housing, advertising or MLS rules;
- upload someone else's information or content without authority, or content that infringes another person's rights;
- share your login, resell the service, or use it for a competing service;
- attempt to access other people's data, probe or break our security, scrape the workspace, or interfere with the service;
- upload malware, or use the service to send unsolicited bulk messages.
14. Confidentiality
We treat your listing, client and transaction information as confidential and use it to deliver and support the service. We share it with the people and providers who need it to do that work, and where the law requires.
You agree to keep non-public information we share with you — including pricing, processes and workspace materials — confidential.
15. Intellectual property
We own the service, the software, our workflows, templates and branding. You get a limited, non-exclusive, non-transferable right to use the service for your own real estate business while your access is active.
You keep ownership of the content you supply — listing data, documents, photos and media you have the right to use. You give us permission to use it to deliver the service, including passing it to the vendors and platforms your order requires.
You confirm you have the rights to any photography or media you upload. We may use anonymised, aggregated information about how the service is used to improve it.
16. Electronic communications
You agree to receive agreements, notices, receipts, work updates and other communications electronically — in the workspace and by email to the address on your account. Service and transactional messages are part of using the service.
Keep your email address current. Notices to us should go to support@thelistbar.com.
17. Disclaimers
Except as these terms expressly state, the service is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows.
We do not warrant that the service will be uninterrupted or error-free, that stored data will never be lost, or that third parties will perform as expected.
18. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost commissions, lost transactions, lost data or lost opportunity.
Our total liability for any claim is limited to the amount you paid us for the specific service or order the claim relates to, or, for a claim about a monthly plan, the plan fees you paid us in the twelve months before the claim.
These limits do not apply where they cannot lawfully apply, including fraud, wilful misconduct, or any liability that cannot be limited or excluded under applicable law.
19. Indemnity
You agree to defend, indemnify and hold harmless The List Bar and its owners, staff and contractors from claims, losses and reasonable costs arising from your use of the service, your content and instructions, your authority to share third-party information, your compliance with brokerage, MLS, advertising and fair housing rules, and your breach of these terms.
20. Suspension and termination
You can stop using the service at any time and cancel a monthly plan as described above. We may suspend or end access for non-payment, for a breach of these terms, for risk to the service or to other people, or where the law requires it.
When access ends, unpaid amounts remain due and completed work already paid for is not refunded. Ask us at support@thelistbar.com for a copy of your records before or shortly after access ends.
21. Governing law and disputes
These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. The exclusive venue for any dispute is the state or federal courts located in Denver County, Colorado, and both parties consent to that venue.
There is no mandatory arbitration and no class-action waiver in these terms. Please contact us first at support@thelistbar.com — most issues are resolved quickly.
22. Changes to these terms
We may update these terms. The version and effective date are shown at the top of this page. For a material change, we will ask you to accept the new version the next time you sign in, and we keep a record of what you accepted and when.
Continuing to use the service after an update means you accept the updated terms.
23. General
These terms, together with the package, plan or order details presented at purchase, are the whole agreement between us. If any part is unenforceable, the rest still applies. Our not enforcing a right immediately does not waive it. You may not transfer these terms without our consent; we may transfer them in connection with a merger, acquisition or sale of the business.
